Terms of Service

These Terms of Service ("Terms") govern your use of the Harmonia mobile application ("the App"), developed by Rowan Vredenburg ("we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. License to use the App
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own entertainment on devices you own or control, subject to these Terms and the rules of the app store from which you downloaded it.
2. In-app purchases and virtual items
The App offers optional in-app purchases, including a one-time "Remove Ads" purchase and consumable items (such as life refills, replays, and hints). All purchases are processed by Apple or Google under their terms. Consumable items are consumed within the App, have no monetary value, cannot be exchanged for real money, and are not transferable. Except where required by law or by the applicable app store's refund policy, purchases are non-refundable. Refund requests should be directed to Apple or Google, as they process all payments.
Purchases and game progress are stored on your device. Deleting the App or switching devices may result in the loss of consumable items and progress. The "Remove Ads" purchase can be restored on the same store account using the App's restore functionality where available.
3. Advertising
The App displays third-party advertisements unless you purchase "Remove Ads". We are not responsible for the content of third-party advertisements or for the products and services they promote.
4. Acceptable use
You agree not to: (a) copy, modify, distribute, sell, or lease any part of the App; (b) reverse engineer or attempt to extract the source code of the App except where permitted by law; (c) use the App in any unlawful manner or to circumvent its purchase mechanisms; or (d) interfere with the operation of the App or its services.
5. Intellectual property
The App, including its design, graphics, audio, and code, is owned by us or our licensors and is protected by copyright and other intellectual property laws. Third-party assets used in the App are credited within the App. These Terms do not grant you any rights to our trademarks or other brand elements.
6. Availability and changes
We may update, modify, or discontinue the App or any feature of it (including the daily challenge) at any time without notice. We do not guarantee that the App will always be available, uninterrupted, or error-free.
7. Disclaimer of warranties
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
8. Limitation of liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of or inability to use the App. Our total liability for any claim arising out of these Terms or the App shall not exceed the amount you paid us through the App in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited by law.
9. Termination
These Terms are effective until terminated. We may terminate or suspend your license if you breach these Terms. You may terminate at any time by deleting the App. Sections 5, 7, 8, and 10 survive termination.
10. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. Nothing in these Terms deprives you of protections you are entitled to under the mandatory consumer protection laws of your country of residence.
11. Changes to these Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
